Politična policija?Political police?

Ne gre za novo enoto Policije RS. Gre za spor o noveli Zakona o parlamentarni preiskavi: koliko moči sme dobiti politična večina in katere hitre varovalke morajo zaščititi posameznika, opozicijo, medije in javni interes.This is not a new police unit. It is a dispute about amendments to Slovenia’s Parliamentary Inquiry Act: how much investigative power a political majority should have, and which fast safeguards must protect individuals, opposition, media, and the public interest.

Kratka ocena: parlamentarna preiskava mora ostati učinkovito orodje nadzora oblasti. Ne sme pa postati politično orožje brez hitre zunanje kontrole. Najboljši kompromis ni slepi referendum, ampak popravek zakona: hitra preiskava + hitro pravno varstvo + avtomatski iztek poskusne ureditve.Short assessment: parliamentary inquiry must remain an effective tool for holding power accountable. It must not become a political weapon without fast external review. The best compromise is not a blind referendum, but a legal fix: fast inquiry + fast legal protection + automatic expiry of the trial regime.

Osnovna razlika: “politična policija” je slogan in opozorilo, ne uradno ime nove institucije. Pravo vprašanje je bolj trezno: ali novela dovolj dobro prepreči, da parlamentarna preiskava ne postane šikaniranje političnih nasprotnikov, novinarjev, civilne družbe ali zasebnikov?Basic distinction: “political police” is a slogan and warning, not the official name of a new institution. The calmer question is whether the amendment sufficiently prevents parliamentary inquiry from becoming harassment of political opponents, journalists, civil society, or private persons.

Stran povzema najino debato: najprej razčisti, kaj zakon sploh je, nato loči argumente za in proti, na koncu pa doda konkretno varovalko — poskusno obdobje z avtomatskim iztekom.

Ključna misel: referendum je legitimna zasilna zavora, vendar slab način za tehnično-pravno odločanje. Bolj odrasla rešitev je javna strokovna razprava in popravek zakona pred tem, ko ljudi potisnemo v glasovanje po političnem plemenu.

Parlamentarna preiskava je orodje politične odgovornosti in nadzora, vendar uporablja močna poizvedovalna pooblastila.A parliamentary inquiry is a tool of political accountability and oversight, but it uses strong investigatory powers.

Ustava določa, da Državni zbor lahko odredi preiskavo o zadevah javnega pomena. Komisija ima pri poizvedovanju in preučevanju smiselno enaka pooblastila kakor pravosodni organi.

Zato je meja občutljiva: formalni cilj so javne funkcije, politična odgovornost in zakonodaja, praktično pa lahko preiskava zadene tudi priče, novinarje, podjetja, civilno družbo ali zasebnike.

The Constitution allows the National Assembly to order an inquiry into matters of public importance. The commission has, for inquiry and examination, powers comparable in effect to judicial bodies.

That makes the boundary sensitive: the formal target is public office, political accountability, and legislation, but in practice an inquiry can also affect witnesses, journalists, businesses, civil society, or private persons.

Four tones are visible: some fear the majority will manufacture scandals against people it dislikes; others argue elected politicians deserve stronger scrutiny; a third group distrusts parliamentary commissions and would leave investigations to professional bodies; a fourth sees the referendum as excessive because inquiries need to be unblocked.

Parliamentary inquiry is necessary. Political abuse of inquiry is dangerous. A referendum is legitimate, but crude. Expert debate and a legal repair are better. A trial clause with automatic expiry is the cleanest safeguard if politics truly wants to test a new regime.
